TERMS OF SERVICE

Location: OTP Soccer (in collaboration with Killian Palms Country Club), 9950 SW 104th St, Miami, FL 33176

  1. Acceptance of Terms
    1.1. These Terms of Service (the “Terms”) govern your access to and use of any products, services, or facilities (collectively, the “Services”) provided by OTP Soccer (“Company”), in partnership with Killian Palms Country Club.
    1.2. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you are prohibited from using the Services.

  2. Eligibility
    2.1. Adults. Individuals who are at least 18 years of age may reserve and use the Services.
    2.2. Minors. Individuals under 18 years of age may participate only if a parent or legal guardian signs a waiver on their behalf and consents to these Terms in writing. A parent or guardian must remain present and supervise the minor at all times.

  3. Reservation and Payment
    3.1. Booking. Full payment is required at the time of booking to secure a reservation. All reservations are subject to availability.
    3.2. Methods of Payment. Acceptable payment methods shall be as determined by Company from time to time (e.g., credit cards, electronic payments).
    3.3. Late Arrival. Late arrival may result in reduced playing time, or in the Company’s sole discretion, forfeiture of the reservation without refund.

  4. Refund Policy
    4.1. Cancellations and refunds are governed by the separate Refund Policy, which is incorporated herein by reference. By using the Services, you acknowledge that you have reviewed and agreed to the Refund Policy.

  5. Facility Rules
    5.1. Conduct. You agree to abide by all rules, regulations, and instructions communicated by Company staff or posted on the premises. Prohibited conduct includes, but is not limited to, fighting, abusive language, harassment, or any behavior that poses a risk to others or to property.
    5.2. Equipment and Attire. Proper athletic footwear (e.g., turf or non-metal cleats), shin guards, and athletic attire are required. Company reserves the right to deny entry to any individual who fails to comply with these requirements.
    5.3. Prohibited Items. The possession or use of glass containers, outside alcohol, illicit substances, or any dangerous items is strictly prohibited.

  6. Assumption of Risk
    6.1. You acknowledge and understand that participation in soccer activities (including, but not limited to, playing, practicing, and observing) involves inherent risks, including but not limited to physical injury, property damage, disability, and death.
    6.2. By using the Services, you voluntarily assume all risks, hazards, and dangers arising from or relating to such participation.

  7. Release of Liability
    7.1. To the fullest extent permitted by law, you hereby release and forever discharge OTP Soccer and Killian Palms Country Club, including their respective owners, officers, directors, employees, agents, successors, and assigns (collectively, the “Released Parties”), from any and all claims, demands, actions, causes of action, damages, liabilities, costs, or expenses (including attorneys’ fees) arising out of or in connection with any injury or loss sustained in relation to your use of the Services.

  8. Indemnification
    8.1. You agree to indemnify, defend, and hold the Released Parties harmless from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms or your negligent or wrongful acts while using the Services.

  9. Media Release
    9.1. By entering the premises or participating in the Services, you grant the Company the right to record, photograph, and otherwise capture your likeness, and to use such media for promotional, marketing, or other lawful purposes without compensation or further approval.

  10. Governing Law and Venue
    10.1. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without reference to its conflict of laws provisions.
    10.2. Any dispute arising under or related to these Terms shall be exclusively brought in the state or federal courts located in Miami-Dade County, Florida, and you hereby consent to the personal jurisdiction and venue of those courts.

  11. Changes to These Terms
    11.1. The Company reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Services after such modifications have been posted constitutes your acceptance of the revised Terms.
